    In light of the COVID-19 pandemic, protecting the health and safety of the community is of utmost concern.  If you wish to submit written testimony on any agenda item, please email your testimony to mvi@dcca.hawaii.gov or submit by hard copy mail to: Attn: Motor Vehicle Industry Licensing Board, P.O. Box 3469, Honolulu, HI 96801. We request submission of testimony at least 24 hours prior to the meeting to ensure that it can be distributed to the Board members.

    To view the meeting and provide live oral testimony, please use the link at the top of the agenda. You will be asked to enter your name. The Board requests that you enter your full name, but you may use a pseudonym or other identifier if you wish to remain anonymous. You will also be asked for an email address.  You may fill in this field with any entry in an email format, e.g., *****@***mail.com.

     

    Your microphone will be automatically muted. When the Chairperson asks for public testimony, you may click the Raise Hand button found on your Zoom screen to indicate that you wish to testify about that agenda item.  The Chairperson will individually enable each testifier to unmute their microphone. When recognized by the Chairperson, please unmute your microphone before speaking and mute your microphone after you finish speaking. 

     

    PHONE ACCESS:

     

    If you cannot get internet access, you may get audio-only access by calling the Zoom Phone Number listed at the top on the agenda. 

     

    Upon dialing the number, you will be prompted to enter the Meeting ID which is also listed at the top of the agenda.  After entering the Meeting ID, you will be asked to either enter your panelist number or wait to be admitted into the meeting.  You will not have a panelist number.  So, please wait until you are admitted into the meeting. 

     

    When the Chairperson asks for public testimony, you may indicate you want to testify by entering “*” and then “9” on your phone’s keypad.  After entering “*” and then “9”, a voice prompt will let you know that the host of the meeting has been notified.  When recognized by the Chairperson, you may unmute yourself by pressing “*” and then “6” on your phone.  A voice prompt will let you know that you are unmuted.  Once you are finished speaking, please enter “*” and then “6” again to mute yourself.

    A.            Email inquiry from Division of Purchasing, County of Kauai, seeking clarification on Chapter 437, HRS, and if they can procure motor vehicles from out-of-state motor vehicle dealers and subsequently ship the motor vehicle to Hawaii.

     

    6.            2022 Proposed Legislation:

     

    A.            Bills Relating to HRS Chapter 437 – Motor Vehicle Industry Licensing Act

     

                                  i.                HB 393, HD1 RELATING TO GROUND TRANSPORTAION

     

    Establishes goals for the State to reduce emissions that cause climate change and build energy efficiencies across all sectors, including establishing a clean ground transportation target for light duty vehicles. Prohibits the sale of new motor vehicles that are solely powered by fossil fuels and designed for personal use beginning           ,     , by motor vehicle dealers and salespersons.

     

                                 ii.                HB 463 RELATING TO CLIMATE CHANGE

     

    Sets the goal of employing one hundred percent clean ground transportation for the public and private transportation sectors by December 31, 2030. Requires all light duty motor vehicles procured pursuant to the Hawaii Public Procurement Code to be powered by renewable sources by January 1, 2030. Accelerates the State’s goal of becoming one hundred percent reliant on clean energy and reaching its zero emissions clean energy target to 2030. Increases the goal for electricity use reductions achieved under the State’s energy-efficiency portfolio standards. Prohibits the sale of new motor vehicles powered solely by fossil fuels by January 1, 2030.

     

                                iii.                HB 602/SB 171 RELATING TO REGISTRATION OF VEHICLES

     

    Amends the procedure of transferring the title or ownership interest in a vehicle. Requires the transferor, or transferor’s representative with the appropriate documentation, and transferee to be appear in person before the clerk of the respective county department of motor vehicles to execute the transfer of title. Exempts licensed dealers from appearing in person with the transferee to execute such transfer.

     

                               iv.                HB 804 RELATING TO ENVIRONMENTAL PROTECTION

     

    Prohibits the sale by motor vehicle dealers and salespersons of new motor vehicles that are solely powered by fossil fuels and designed for personal use beginning 1/1/2035.

     

                                 v.                SB 21 RELATING TO MOTOR VEHICLES

     

    Beginning January 1,      , establishes a zero net vehicle growth policy in the State to ensure that the number of vehicles in the State does not exceed the vehicle threshold. Prohibits the importation of a vehicle into the State unless the dealer or individual importing the vehicle demonstrates proof that an existing vehicle in the State was recycled, destroyed, or transported out of the State and the importation of the vehicle does not cause the total number of vehicles in the State to exceed the vehicle threshold. Requires proof of compliance for dealers and individuals importing vehicles into the State.

     

    B.            Other Bills Related to Motor Vehicles

     

     

                                  i.                HB 154 / SB425 RELATING TO REGISTRATION OF VEHICLES

     

    Requires a motor vehicle transferor, or the transferor’s representative, and transferee to appear in person to execute the transfer of a motor vehicle. Subjects motor vehicle transferors to certain fees previously assessed on motor vehicle transferees.

     

                                 ii.                HB159 HD1 / SB432 SD1 RELATING TO REGISTRATION OF VEHICLES

     

    Requires a motor vehicle transferor, or the transferor’s representative, and transferee to appear in person to execute the transfer of a motor vehicle, except in certain situations. Subjects motor vehicle transferors to certain fees previously assessed on motor vehicle transferees. Effective 7/1/2050.

     

                                iii.                HB 602 / SB171 RELATING TO REGISTRATION OF VEHICLES

     

    Amends the procedure of transferring the title or ownership interest in a vehicle. Requires the transferor, or transferor’s representative with the appropriate documentation, and transferee to be appear in person before the clerk of the respective county department of motor vehicles to execute the transfer of title. Exempts licensed dealers from appearing in person with the transferee to execute such transfer.

     

                               iv.                SB 373 RELATING TO MOTOR VEHICLES

     

    Requires motor vehicle insurers to notify the county director of finance of cancellations and nonrenewals of motor vehicle insurance policies on registered vehicles. Requires transferees to notify the county director of finance of motor vehicle insurance policy coverage for the transferred vehicles. Increases registration fines for a failure to maintain insurance on the vehicle during the period of registration.

     

                                 v.                HB 1411 RELATING TO REGISTRATION OF VEHICLES

     

    Requires that both the transferee’s and transferor’s address be provided on the certificate of ownership when the title to a motor vehicle is transferred. Clarifies that the signature of the transferee and the signature of the transferor each serve as an attestation by that respective party as to the validity of the information on the certificate of ownership. Specifies that providing false or fraudulent information subjects a party to penalties. Effective 7/1/2023.
