In light of the COVID-19 pandemic, protecting the health and safety of the community is of utmost concern. If you wish to submit written testimony on any agenda item, please email your testimony to medical@dcca.hawaii.gov or by hard copy mail to: Attn: Hawaii Medical Board, P.O. Box 3469, Honolulu, HI 96801.  We request submission of testimony at least 24 hours prior to the meeting to ensure that it can be distributed to the Board members.

To view the meeting and provide live oral testimony, please use the link at the top of the agenda. You will be asked to enter your name. The Board requests that you enter your full name, but you may use a pseudonym or other identifier if you wish to remain anonymous. You will also be asked for an email address.  You may fill in this field with any entry in an email format, e.g., *****@***mail.com.

 

Your microphone will be automatically muted. When the Chairperson asks for public testimony, you may click the Raise Hand button found on your Zoom screen to indicate that you wish to testify about that agenda item.  The Chairperson will individually enable each testifier to unmute their microphone. When recognized by the Chairperson, please unmute your microphone before speaking and mute your microphone after you finish speaking.

If you cannot get internet access, you may get audio-only access by calling the Zoom Phone Number listed at the top on the agenda. 

 

Upon dialing the number, you will be prompted to enter the Meeting ID which is also listed at the top of the agenda.  After entering the Meeting ID, you will be asked to either enter your panelist number or wait to be admitted into the meeting.  You will not have a panelist number.  So, please wait until you are admitted into the meeting. 

 

When the Chairperson asks for public testimony, you may indicate you want to testify by entering “*” and then “9” on your phone’s keypad.  After entering “*” and then “9”, a voice prompt will let you know that the host of the meeting has been notified.  When recognized by the Chairperson, you may unmute yourself by pressing “*” and then “6” on your phone.  A voice prompt will let you know that you are unmuted.  Once you are finished speaking, please enter “*” and then “6” again to mute yourself.

 

For both internet and phone access, when testifying, you will be asked to identify yourself and the organization, if any, that you represent.  Each testifier will be limited to five minutes of testimony per agenda item.

The Board may enter into Executive Session to consult with the Board’s attorney on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities in accordance with Hawaii Revised Statute (“HRS”) section 92-5(a)(4) to review the executive session minutes.

A.               In the Matter of the License to Practice Medicine of Dennis I. Ayon, M.D.; MED-2010-109-L; Board’s Final Order.

 

**Dr. Ayon legally changed his name to Thomas Isadore, M.D.

5.               Legislation:

 

A.               HB1575, HD2, RELATING TO PHYSICIAN ASSISTANTS

 

Expands the scope of practice for physician assistants. Requires a sampling of medical records, rather than all medical records, to be reviewed when physician assistants prescribe controlled substances. 

 

B.             HB1667, HD2/SB2592, SD1, RELATING TO HEALTH

 

Defines “clinical laboratory director” to include certain physicians, licensed clinical laboratory scientists, and pharmacists-in-charge of pharmacies. Amends the definition of “practice of pharmacy” to include the ordering and performing of certain Clinical Laboratory Improvement Amendments waived tests.

 

C.              HB1675, HD1, RELATING TO MEDICAL CARE FOR MINORS

 

Permits minors to consent to medical care and services related to the diagnosis, treatment, or prevention of HIV. Specifies that a minor, under certain circumstances, shall not be liable for payment associated with the diagnosis, treatment, or prevention of HIV. Authorizes physician assistants, in addition to physicians and advanced practice registered nurses, to render such medical care and services to minors.

 

D.              SB2645, SD1, RELATING TO ACCESS TO BEHAVIORAL HEALTH SERVICES

 

Allows for standard telephone contacts for telehealth purposes related to behavior health services.

 

E.               HB1823, HD1/SB2680, SD1, RELATING TO HEALTH

 

Authorizes advanced practice registered nurses, in addition to physicians, to practice medical aid in dying in accordance with their scope of practice and prescribing authority. Authorizes psychiatric mental health nurse practitioners and clinical nurse specialists, in addition to psychiatrists, psychologists, and clinical social workers, to provide counseling to a qualified patient. Reduces the mandatory waiting period between oral requests from twenty days to fifteen days. Waives the mandatory waiting period for those terminally ill individuals not expected to survive the mandatory waiting period.

 

F.               HB2437, HD1, RELATING TO TAXATION

 

Establishes a $10,000 income tax credit for physicians, osteopathic physicians, and nurses who are licensed and actively practicing in the State. Requires the Hawaii state center for nursing to report to the legislature on impact and effect of the tax credit by December 31, 2024. Sunsets December 31, 2025.

 

G.              SB2241, SD1, RELATING TO MEDICAL CARE FOR MINORS

 

Permits minors to consent to medical care related to the diagnosis or treatment of HIV or the prevention of HIV. Provides that a minor, under certain circumstances, shall not be liable for payment for treatment or prevention of HIV. Provides that a health insurer of a minor’s parent, guardian, custodian, or spouse shall not notify the parent guardian, custodian, or spouse of the minor’s treatment or prevention of HIV. Authorizes physician assistants, in addition to physicians and advanced practice registered nurses, to render medical care and services to minors.

 

H.              SB2442, SD1, RELATING TO PHYSICIAN ASSISTANTS

 

Streamlines the records review process for physician assistants by including review of physician assistants’ prescriptions for controlled substances.

 

I.                 SB2445, SD2, RELATING TO PHYSICIAN ASSISTANTS

 

Expands the authorized scope of practice for physician assistants.

 

J.             SB2282, SD1, RELATING TO ABORTION CARE

 

Clarifies that access to abortion care is inclusive of all pregnant people in the State. Repeals a criminal penalty for violations of certain abortion provisions. Clarifies that advanced practice registered nurses may provide abortion care.

 

K.            SB2017, SD1, RELATING TO EMERGENCY MEDICAL SERVICES

 

Repeals section 453-34(d), HRS, which limits licensure as an emergency medical technician 1 to individuals whose practice is performed in a county with a population of 500,000 or greater.

 

L.             SB2026, RELATING TO THE EMERGENCY MEDICAL SERVICES PERSONNEL LICENSURE INTERSTATE COMPACT

 

Enters Hawaii into the Emergency Medical Services Personnel Licensure Interstate Compact to allow EMS personnel from other states to practice in Hawaii during a declared emergency.

 

 

 

6.               Federation of State Medical Boards

 

a.               FSMB Workgroup on Diversity, Equity and Inclusion in Medical Regulation and Patient Care

  

The FSMB Workgroup on Diversity, Equity and Inclusion (DEI) in Medical Regulation and Patient Care has been tasked with identifying best practices for state medical and osteopathic boards to help recognize, mitigate and eliminate racism, discrimination and systemic inequities in medical regulation and patient care. The Workgroup’s Interim Report contains an update on its work to date, as well as several recommendations and resources to help promote equity in medical regulation and health care.  The Board will review and provide comment on the interim draft report.
