The Office of Administrative Hearings (OAH)

The OAH conducts administrative hearings and recommended orders issues decisions for the Department of Commerce and Consumer Affairs. We ensure due process for all contested cases in accordance with (HRS) Chapters 91 and 92.

A description of OAH’s Mission

The kinds of cases heard by the Office of Administrative Hearings include:

  • Disciplinary proceedings against professional and vocational licensees.
  • Hearings to contest the denial of an application for licensure or registration, or the denial of an application for renewal or restoration.
  • Hearings to contest the issuance of citations for engaging in activities for which a professional or vocational license is required.
  • Disputes involving the denial or withholding of no-fault or personal injury protection benefits.
  • Disputes involving the legal ownership of trade names, trade marks, partnership names, and corporate names.
  • Hearings to contest the issuance of cease and desist orders issued by the Boards, Commissions, programs, and Divisions of the Department of Commerce and Consumer Affairs.

Scope Of Authority

Other Areas of Jurisdiction

  • Disputes arising from the State’s procurement laws pursuant to HRS Chapter 103D;
  • Contested case hearings involving the Employees’ Retirement System of the State of Hawai’i; and
  • Disputes among manufacturers, distributors, or dealers of motor vehicles covered by Part II of HRS Chapter 437.
  • Tort claims against design professionals under the provisions of HRS Chapter 672B (the Design Claim Conciliation Panel);
  • Medical inquiries under the provisions of HRS Section 671-11 et seq. (the Medical Inquiry and Conciliation Panel) beginning January 1, 2013;
