In light of the COVID-19 pandemic, protecting the health and safety of the community is of utmost concern. If you wish to submit written testimony on any agenda item, please email your testimony to medical@dcca.hawaii.gov or by hard copy mail to: Attn: Hawaii Medical Board, P.O. Box 3469, Honolulu, HI 96801. We request submission of testimony at least 24 hours prior to the meeting to ensure that it can be distributed to the Board members.

The Board requests that you enter your full name, but you may use a pseudonym or other identifier if you wish to remain anonymous. You will also be asked for an email address. When the Chairperson asks for public testimony, you may click the Raise Hand button found on your Zoom screen to indicate that you wish to testify about that agenda item. The Chairperson will individually enable each testifier to unmute their microphone. When recognized by the Chairperson, please unmute your microphone before speaking and mute your microphone after you finish speaking.

If you cannot get internet access, you may get audio-only access by calling the Zoom Phone Number listed at the top on the agenda.
Upon dialing the number, you will be prompted to enter the Meeting ID which is also listed at the top of the agenda. After entering the Meeting ID, you will be asked to either enter your panelist number or wait to be admitted into the meeting. You will not have a panelist number. So, please wait until you are admitted into the meeting.
When the Chairperson asks for public testimony, you may indicate you want to testify by entering “*” and then “9” on your phone’s keypad. After entering “*” and then “9”, a voice prompt will let you know that the host of the meeting has been notified. 2. Approval of the Open Session and Executive Session Minutes of the January 20, 2022, Meeting
The Board may enter into Executive Session to consult with the Board’s attorney on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities in accordance with Hawaii Revised Statute (“HRS”) section 92-5(a)(4) to review the executive session minutes.

A. DC84 REPORT: ANNUAL REPOR ON FINDINGS FROM THE HAWAII PHYSICIAN WORKFORCE ASSESSMENT
Report filed by the University of Hawaii dated November 30, 2021, transmitting the Annual Report on Findings from the Hawaii Physician Workforce Assessment Project pursuant to Act 18, Section 5, Special SLH 2009.
B. HB472, HD1 RELATING TO TELEHEALTH
Exempts telehealth-related gifts from procurement requirements. Codifies the authorization of advanced practice registered nurses to use telehealth to assist a patient, including those advanced practice registered nurses who are not licensed in the State, under certain conditions. Makes permanent certain telehealth-related exemptions for licensed health professions issued by recent gubernatorial proclamation. Effective 7/1/2050. (HD1)
C. HB473, HD2/SB970 RELATING TO TELEHEALTH
Authorizes the establishment of a physician-patient relationship via a telehealth interaction, if the physician is licensed to practice medicine in the State. Effective 7/1/2050. (HD2)
D. HB487/SB839 RELATING TO HEALTH
Authorizes advanced practice registered nurses, in addition to physicians, to practice medical aid in dying in accordance with their scope of practice and prescribing authority. Authorizes psychiatric mental health nurse practitioners, in addition to psychiatrists, psychologists, and clinical social workers, to provide counseling to a qualified patient. Reduces the mandatory waiting period between oral requests from twenty days to fifteen days. Waives the mandatory waiting period for those terminally ill individuals not expected to survive the mandatory waiting period.
E. HB945/SB1099 RELATING TO THE PRACTICE OF MEDICINE
Clarifies the definition of the practice of medicine to provide uniformity of practice for both medical physicians and osteopathic physicians.
F. HB1575 RELATING TO PHYSICIAN ASSISTANTS
Expands the scope of practice for physician assistants. Requires a sampling of medical records, rather than all medical records, to be reviewed when physician assistants prescribe controlled substances.
G. HB1667/SB2592 RELATING TO HEALTH
Defines “clinical laboratory director” to include certain physicians, licensed clinical laboratory scientists, and pharmacists-in-charge of pharmacies. Amends the definition of “practice of pharmacy” to include the ordering and performing of certain Clinical Laboratory Improvement Amendments waived tests.
H. HB1675/SB2729 TO MEDICAL CARE FOR MINORS
Permits minors to consent to medical care and services related to the diagnosis, treatment, or prevention of HIV. Specifies that a minor, under certain circumstances, shall not be liable for payment associated with the diagnosis, treatment, or prevention of HIV. Authorizes physician assistants, in addition to physicians and advanced practice registered nurses, to render such medical care and services to minors.
I. HB1708/SB2645 RELATING TO ACCESS TO BEHAVIORAL HEALTH SERVICES
Allows for standard telephone contacts for telehealth purposes related to behavior health services.
J. HB1823/SB2680 RELATING TO HEALTH
Authorizes advanced practice registered nurses, in addition to physicians, to practice medical aid in dying in accordance with their scope of practice and prescribing authority. Authorizes psychiatric mental health nurse practitioners and clinical nurse specialists, in addition to psychiatrists, psychologists, and clinical social workers, to provide counseling to a qualified patient. Reduces the mandatory waiting period between oral requests from twenty days to fifteen days. Waives the mandatory waiting period for those terminally ill individuals not expected to survive the mandatory waiting period.
K. HB2021/SB2152 RELATING TO HEALTH
Authorizes state-licensed and credentialed physicians, advanced practice registered nurses, and physician assistants, who are not physically in the State, to issue prescriptions for certain controlled substances under a limited circumstance. Authorizes pharmacies to dispense such prescriptions.
L. HB2437 RELATING TO TAXATION
Establishes a $10,000 income tax credit for physicians, osteopathic physicians, and nurses who are licensed and actively practicing in the State.
M. SB323 RELATING TO HEALTH
Authorizes advanced practice registered nurses, in addition to physicians, to practice medical aid in dying in accordance with their scope of practice and prescribing authority. Authorizes psychiatric mental health nurse practitioners, in addition to psychiatrists, psychologists, and clinical social workers, to provide counseling to a qualified patient. Reduces the mandatory waiting period between oral requests from twenty days to fifteen days. Waives the mandatory waiting period for those terminally ill individuals not expected to survive the mandatory waiting period.
N. SB364 RELATING TO SPORTS MEDICINE
Provides a limited exemption from state licensure requirements to out-of-state physicians who accompany a sports team to a specific sporting event in Hawaii or are invited to provide services at a national sport training center, event, or competition in Hawaii, if certain conditions are met. Requires out-of-state physicians to provide notice to the Hawaii medical board.
O. SB598 RELATING TO THE PRACTICE OF MEDICINE
Clarifies the definition of the practice of medicine to provide uniformity of practice between both medical physicians and osteopathic physicians.
P. SB613, SD2/HB313 RELATING TO PHYSICIAN WORKFORCE ASSESSMENT
Repeals the requirement that no less than fifty per cent of the physician workforce assessment fees deposited into the John A. Burns school of medicine special fund be used for purposes identified by the Hawaii medical education council. Repeals the monetary cap of expenditures from the John A. Burns school of medicine special fund. Authorizes the John A. Burns school of medicine special fund to provide loan repayment to certain physicians and scholarships to qualifying medical students. Effective 7/1/2050. (SD2)
Q. SB624/HB576 RELATING TO HEALTH CARE
Authorizes licensed physician assistants and advanced practice registered nurses to perform certain abortions.
R. SB846 RELATING TO MEDICAL RESIDENCY PROGRAMS
Appropriates funds to support and expand physician residency training programs in state teaching hospitals. Requires dollar-for-dollar matching funds from private funding sources.
S. SB1258, SD1, HD1/HB1120 RELATING TO TELEHEALTH
Authorizes the establishment of a physician-patient relationship via a telehealth interaction, if the physician is licensed to practice medicine in the State. Effective 7/1/2060. (HD1)
T. SB2199 RELATING TO TREATMENT OF CORONAVIRUS DISEASE 2019
Protects physicians, advanced practice registered nurses, and pharmacists from civil and criminal liability for prescribing or administering early treatment for the coronavirus disease 2019 in good faith to prevent hospitalization and death.
U. SB2241 RELATING TO MEDICAL CARE FOR MINORS
Permits minors to consent to medical care related to the diagnosis or treatment of HIV or the prevention of HIV. Provides that a minor, under certain circumstances, shall not be liable for payment for treatment or prevention of HIV. Authorizes physician assistants, in addition to physicians and advanced practice registered nurses, to render medical care and services to minors.
V. SB2442 RELATING TO PHYSICIAN ASSISTANTS
Streamlines the records review process for physician assistants by including review of physician assistants’ prescriptions for controlled substances.
W. SB2445 RELATING TO PHYSICIAN ASSISTANTS
Expands the authorized scope of practice for physician assistants.
X. HB1484/SB2017 RELATING TO EMERGENCY MEDICAL SERVICES
Repeals section 453-34(d), HRS, which limits licensure as an emergency medical technician 1 to individuals whose practice is performed in a county with a population of 500,000 or greater.
Y. SB455/HB214 RELATING TO EMERGENCY MEDICAL SERVICES
Certification of Emergency Medical Technicians (EMTs) to include personnel with proper certifications, to be deemed qualified to perform emergency medical services as EMTs in the State.
Z. SB2026 RELATING TO THE EMERGENCY MEDICAL SERVICES PERSONNEL LICESNRUE INTERSTATE COMPACT
Enters Hawaii into the Emergency Medical Services Personnel Licensure Interstate Compact to allow EMS personnel from other states to practice in Hawaii during a declared emergency.
